In the last 10 years, OLIVARES has processed and obtained nearly 20,000 patents, achieved by a dedicated team of lawyers and engineers with unique knowledge and experience in the Mexican Patent System. With more than half a century of experience, OLIVARES represents many leading companies in innovation, as well as numerous companies with substantial technical specializations, and often high-value patent portfolios.

In 1969, OLIVARES became the first firm in Mexico to bring together scientific and legal knowledge, providing a comprehensive leading-edge approach to patent protection. OLIVARES’ technical specialists are currently integrated into three large working groups:

Each patent working group is headed by a senior associate, with extensive experience in the area and in the particularities of processing and obtaining patents in these fields. In each group, engineers, and scientists, along with expert patent paralegals, work together to facilitate the prompt filing and attention to patent applications, both digitally and in person, when necessary, at the Mexican Institute of Industrial Property (IMPI) and with the National Seed Inspection and Certification Service (SNICS).

In certain countries in the Latin America, it can be difficult to find the technical skills required to obtain successful patent results. OLIVARES has a network of partners throughout the Americas, which have been selected for their high level of specialization and reliable success records, significantly reducing client risk.

OLIVARES’ patent team works closely with the firm’s litigation team to enforce client’s rights against third parties who misappropriate the patented technology.

For years, OLIVARES’ team has led the way in obtaining the validity correction of patents in Mexico, obtaining patents related to software and expanding the patent linkage system before the Supreme Court of Justice to include those that protect pharmaceutical formulations and pharmaceutical use patents.

OLIVARES’ Partners and Associates have been active contributors both to the discussion of the current Federal Industrial Property Protection Law in Mexico, and in the negotiation of the most recent international treaties, including on the subject of Intellectual Property related to the United States-Mexico-Canada Agreement (USMCA) and the Trans-Pacific Partnership (TPP).

Sergio L. Olivares Sr. joined OLIVARES in 1987 and today leads the firm with strength and a commitment to transparency, client satisfaction, and personal service. He has been a partner since 1994 and Chairman of the Management Committee since 2009.

Daniel Sanchez joined OLIVARES in 2000 and became a partner in 2011. He is one of the leading intellectual property (IP) and administrative litigators in Mexico and is recognized by industry rankings and publications.

Alejandro Luna F.

Partner

Alejandro Luna joined OLIVARES in 1996 and being made partner in 2005, he has been instrumental to the firm’s IP Litigation, Regulatory, and Administrative Litigation practices. He co-chairs the Life Sciences & Pharmaceutical Law industry group and coordinates the Litigation Department.
